Dereliction of duty what a CROCK!! (SELECTIVE ENFORCEMENT) LAWLESS LFPD Officers Rick Heurung and Jeremy Doroff

Alderman Brad Hircock breaks the law and gets by with it.  Officer Rick Heurung disobeys his chiefs orders, doesn't enforce the sign ordinance fairly or consistently and HE GETS BY WITH IT TOO.  

AND AS OF 8-14-15 LFPD daily police reports have been removed from online....right after I file an incident report on Officer Rick Heurung.  This REEKS of corruption. What are they hiding? Answer: PLENTY.  The public deserves better.
Almost immediately after I posted these comments to tmac on the disqus commentary thread of MCRecord, the daily police reports were REMOVED BY LFPD CHIEF SCHIRMERS from the website.   Hmmmm.   See the connection folks.  I do.

Just as some folks suspected, tmac doesn't care if the daily police reports have been removed from the LFPD website.

This is video(above) of Alderman Brad Hircocks home being visited at 12 pm on 6-26-15 about the 2 illegal road right of way garage sale sign complaint. NOTICE THE GOLF CART LEAVING ON THE CITY STREET THAT CAME OUT OF MORRISON COUNTY SHERIFFS DEPARTMENT CHAPLAIN GREG VALENTINES DRIVEWAY.  Why didn't Officer Rick Heurung issue a citation to the male driver of the golf cart. It is ILLEGAL to drive a golf cart on roadways.

Now see the 2 photos of her home at 1203 First Ave.SW .....both taken 7-3-15.  She has 4 flags erected and only allowed 2.  She was sent a warning letter last year, explaining the limit.  She must feel she is above the law too.

Is this misconduct?

instructing officer to confiscate illegal road right of way signs and bring to police department.  Why doesn't Chief Schirmers letter include ALL his officers, and ALL of the Morrison County Sheriffs deputies?   Why is he picking and choosing who gets correct, critical information and who doesn't? Or doesn't he care?

Above is another illegal road right of way sign, along Riverwood Drive, owned by Alderman Brad Hircock family who lives at  16781       Mississippi Boulevard where this garage sale took place. Officer Rick Heurung drove right PAST this sign as well at about 12:15 pm on 6-26-15. Doesn't Rick understand that watching for public right of way signs and on public utility poles is part of his job?

Picture above taken at   1:57  pm next day 6-27-15.  Officer Jeremy Doroff turned a blind eye to these illegal road right of way signs attached to an electric pole on the road right of way.  

Look this report above was altered from the report put online yesterday 6-26-15. Notice Officer Doroff SAYS he will be taking the sign but my picture above taken today 6-27-15, proves he didn't take it.

Brad Hircock is in the blue shirt, middle of back row under Little Falls sign. Alderman Hircock represents everyone in all 3 wards. He either hasn't read the sign ordinance or just doesn't think HE needs to obey it.  Neither is acceptable. Shame on him.  This is the height of hypocrisy and cronyism.  This is SELECTIVE ENFORCEMENT personnified.  Remember it was only a few weeks ago that Councilman Jerry Knaflas church men held a dinner and had 2 illegal road right of way signs displayed in violation of the sign ordinance.  No wonder I call this council LAWLESS.  Because they are!!!

Here are the updates as promised to show selective and non consistent enforcement of the sign ordinance.(different officers)

Here Officer Rick Heurung, contacts the people who had placed the signs(evidently there was more than the one in the photo), and advised them to take them down. Instead, he should have taken the public right of way sign back to the police garage, and then onto city hall, as required by Chief Schirmers and the MNDot policy states.  Why didn't he.  Does he believe he can decide his own policies?   Probably so, remember this is the same officer that was determined by a formal investigation, to have committed misconduct, by barreling along on 6th Street Northeast at 93 miles an hour in a residential zone.See above letter.

Here Officer John Ruby moves the sign in the public right of way, back, so that it appeared to be in compliance.  That is not what officers are supposed to do with public right of way signs, or those on public utility poles.  They are by order of Chief Schirmers, supposed to be removed and taken back to the police garage. Why did John Ruby decide to do differently?  Does he believe he has the right to make up his own policies?

Now here, Officer Burgardt makes the right choice and removes the sign, as ordered by Chief Schirmers policy, and the MNDot requirement for officers to remove public right of way signs. 

Here in the photo above Captain Kyle Johnson performs his duty correctly, by removing the sign, taking it back to the police station, and then onto city hall.

The photos above, show a garage sale sign IN THE ROAD(not too close to the road as the report states). This sign was not in the public right of way, but was indeed on the road and a real safety hazard. Instead of taking the sign back to the police station, Officer Ben Vanden-Avond, speaks to the owner and asked her to move the sign.  What is notable is that this sign was almost in front of Councilor Loren Boyums home on Golf Road.  

This sign was left  up all winter long 2013 until spring 2014 at the intersection directly in front of the Little Falls Golf Course, where numerous patrol cars pass every day to check on city owned Golf Course.   This sign was located a block from Council Loren Boyums home on Golf Road.   How is it that not one LFPD officer saw this sign in the public right of way, all winter long?   Or do you think they chose NOT to see it?   

This data request was in the city council packet the meeting following it's filing with the city, but the names had been whited out.  Now why do you suppose city staff did that?   They do not white out all names in all data requests.  Only some.   Why do city staff get to pick and choose?  Answer: because YOU let them.  There is absolutely NO oversight of city staff by council or the mayor, or all of this preferential treatment of some, would not be continuing. Like I have stated many times before.....only the faces have changed.  Not how the council/city operates.  You have rogue committee presidents, rogue lawless city staff, lawless council, and heads of critical departments that continue to help create future lawsuits. 

This illegal off premise and public right of way sign on Earl Lemieurs property was erected after your city council approved it.  Now how can that be?   Why would the planning and zoning commission have recommended to the city council that this sign be allowed.   Answer:   Because they could. And did.  It took from April 2014 til September 2014 to get this removed.

This sign is, confirmed to be not permitted(email from Rich Munsch MnDot July 10, 2015) in the public right of way.  It is approximately the same distance from highway 27, as Earl LeMieurs illegal public right of way sign was.  You can see it is right across the highway from Earls property.  Now if I were Earl, I'd be pi$$ed, as he was forced by the city to remove his sign, but the city has ALLOWED this sign, even though I filed an official complaint more than 4 years ago.  Not only is it likely in the public right of way, it is an illegal off premise sign, as not one of the service clubs is located by this sign.....so either way, it is ILLEGAL!!

 These pictures were both taken at city hall on August 4, 2014 after I made a data request to observe all the confiscated signs, and find out the citys tracking system of signs removed from the public right of way, or on public utility poles.  It was then, that I discovered that the city has absolutely NO TRACKING system. This garage sale sign was removed by a LFPD officer and taken to city hall.   Why was the owner of this sign treated much differently than Alderman Brad Hircock on June 26, 2015, when his three garage sale signs(all on public right of way, and 2 attached to city stopsigns) ??  This is another clear example of SELECTIVE ENFORCEMENT OF THE SIGN ORDINANCE.

I guess it is ok for city staff to answer only some peoples emails and not others.   Thanks city, for continuing to demonstrate favoritism that will one day, come back to bite you big time. Promise. Now just to be perfectly clear, I am for everyone having how many signs they want, except in the public right of way.  I do not believe the sign ordinance has ever helped this city, since it has never been enforced fairly and consistently.  I believe it has hurt everyone. The reason the Minnesota legislature allows UNLIMITED SIGNS EVERYWHERE IN THIS STATE,  MONTHS PRIOR TO A GENERAL ELECTION IS BECAUSE SIGNS ON PRIVATE PROPERTY, are NOT A ROAD HAZARD....or they wouldn't allow it.  Does anyone really believe our state legislators would allow unlimited yard signs if they thought people would be injured or die in car accidents because of them?? 

Come on, why would anybody believe the League of Minnesota Cites is advising cities to enact sign ordinances, for reasons other than to curtail certain types of free speech?

League of Minnesota Cities, is very similar to Chamber of Commerce, that greatly FAVORS BUSINESS OWNERS RIGHTS OVER PRIVATE HOMEOWNER RIGHTS. 

  Business needs signage in order to sell, and city residents deserve their free speech.  If you agree.....go the petition online that will force the city by petition to give the voters a say in whether the sign ordinance stays or goes.  http://www.ipetitions.com/petition/lfsignlaw  

If you have not yet signed the petition and live within the city limits of Little Falls, Minnesota(including the newly annexed Belle Prairie area) please do so.   This is the best way to force a sign ordinance change or deletion of it.     

One other important thing about the petition to remove the signordinance.....check out the comments to see the bias  that folks have about a persons Constitutional rights.  It seems as though most of the commentors believe that Christmas signage is more important than a whistleblowers exposure of an illegal war (that continues to this day).   Let's see now, how many of our soldiers died fighting an illegal invasion of Iraq and Afghanistan, based on Bush/Cheney lies?   I have lost count.   What is hard to understand about why I put my signs up?    My signs were, and continue to be one of my only outlets to alert the public about dangerous and corrupt govmint activities.  

The comments on the sign removal petition, are indeed SIGNS......a method of free speech.  How is that different that when I write a letter to the editor, or on this blog, or put out signs, or these people commenting about signs and me.  

All of it is free speech....plain and simple.   I am rather disgusted that there are so many people that believe it would be right to chase anyone out of town, no matter how unpopular that person was or what they had to say.    

Seems pretty unpatriotic  and unAmerican to me.     

Now this is a first in many years.   My data request was not included in the July 6, 2015 council meeting packet online.  Can you figure out why not?
