 Arresting me was one of the dumbest things they have EVER DONE.   Just think of the "circus clown" theme I can portray after I win the appeal.

You can bet your bippy that city atty Toni Wetzels bill also includes some $$ to do with this appeal.

city of Little Falls deleting golf advisory board to avoid legal issues

This is in the packet for council to vote on tomorrow night ...March 16th.  They must FINALLY be concerned about legal ramifications of violating this ORDINANCE(LAW) for 27 years.  Since it was enacted in 1989 the city has NEVER FOLLOWED THIS LAW.  Imagine that.  They are a lawless council....STILL.

Greg Kimman and the next BIG PROBLEM for City of Little Falls

More than a month ago I asked city employee public works director Greg Kimman if his former employer had filed a donation form with the city for his discounted services of labor to design the LFARC area.  (Little Falls Area Recreational Complex).  When any service is donated to the city, the donor must fill out a donation form. This is an official policy that is required legally in order for the city to accept the gift.  He stated that he did not believe the SEH firm had filed one. I explained the necessity of this and he agreed.  As of today there has not been a donation from SEH listed in the city council packets.  This sure appears to be a CONFLICT OF INTEREST.  You see...shortly after the reduced fee was given to the city to design the complex(according to former mayor Cathy VanRisseghem) this gift was thousands of dollars....Greg was hired for the full time position after Jerry Lochner retired.

Folks, this is important because this looks to be ILLEGAL.

Looks to me like bribery of the mayor and city to get the job.

  Greg stated he would look into it but it didn't happen, because city donations ALL APPEAR in the packet of council and it has not shown up.

This matters.

 I have the recording to prove everything I just stated and may broadcast that on here real soon.

My comment that I posted on the disqus forum following the article states:  "About the memorial benches...notice (it wasn't clear why no conditions had been specified in the original agreement, or who instigated the offer of a memorial bench for a $500.00 donation.)  It IS CLEAR THAT ONE OR MORE OF YOUR current or former CITY STAFF....COUNCIL...MAYOR OR CITY ATTORNEY REALLY MESSED UP $$ again $$.  It is no wonder I have questioned for 4 years now...."can they do anything right?"  My guess is the bench memorials were instigated by your former retired city co-administrator.  (The one who held that position just before the current part-time city administrator.)  At this point, "nothing would surprise me".   How about you?  Are you getting a clue how inept this group is?  You should be.  I am making it pretty clear and easy for you.  All you have to do is get the wax out of your ears. 

The person who I was referring to, as being responsible for the initial idea of allowing memorial benches in city parks and on city property, was likely Jerry Lochner.  He has been responsible for quite a number of screw-ups during his long employment for the city of Little Falls. 
    

MORE LAWLESS COUNCIL ONGOING ACTIVITY

Your city council has been violating this ORDINANCE 2.29  since 1989 !!!!! They NEVER MET ONCE PER MONTH AS REQUIRED.  NOT ONCE IN 27 ■■YEARS■■. The lawless council including current council president Jeremy Hanfler (who Is the Vice-President of this board) and the current Mayor Greg Zylka  have done NOTHING to rectify this since 2012 when the Golf Advisory board last met.  It is ILLEGAL FOR GOVERNMENT BODIES TO FUNDRAISE according to Mn. State Auditors office.  Why didn't Toni Wetzel city attorney, INSIST on council following the LAW.   Answer.....cuz SHE AND THEY  feel they are ABOVE THE LAW.....that'$ why.   They do this kind of stuff all the time.  And you let them by not electing people that actually HAVE A CONSCIENCE.   You let them by not ATTENDING WORK SESSION MEETINGS....WHERE THEY MEET IN THE DARK.   Those meetings need to be video recorded and put on local public access channel 180...as Chris Weis the manager of the station wanted to do.  He was told he could NOT FILM AND BROADCAST THEM.   There should be a lot of people DEMANDING BETTER GOVERNMENT AND BETTER LEGAL REPRESENTATION.   "Can" Toni Wetzel for her poor performance....NOW.   Why on earth didn't Dan Vogt city administrator advise council to follow THIS ORDINANCE YEARS AGO??   FIRE HIM IMMEDIATELY TOO FOR misfeasance or malfeasance. I THINK THE ENTIRE COUNCIL could be recalled for misfeasance or malfeasance.....all but the newly elected council has been aware of this illegal activity for years now and DID NOTHING.  Doesn't that piss you off ¿¿¿¿ It is Dan Vogts job to advise council on this kind of stuff. How many violations will it take for you locals to smell the coffee and vote in people that would represent you correctly...follow all laws including the CONSTITUTION¿¿¿¿  Get with it people.  I told you and the LAWLESS COUNCIL  about this long ago and they are just now getting around to dumping the ordinance cuz they don't want to follow it!!!  WAKE UP COMMUNITY.   You are all getting better service from volunteer attendees of meetings than you EVER HAVE by your PAID STAFF and lawless council.  Think about it.

A civil lawsuit filed by Franklin Outdoor Signs for breach of contract?  Which is worse...a Federal Prima Facia As Applied legal challenge for selective enforcement of the sign ordinance or a civil suit from Franklin Outdoor Sign company.  I think you can figure that one out.  Can't you?       

 I am tracking the page views on this post.....so far it is getting a lot of hits.  My guess is city is sweating.  They should be.  They were even warned this time about a potential legal challenge.  A prima facie "as applied" challenge  to the sign ordinance enforcement, to be specific. 

 

 

This should concern EVERYONE....especially our city council, administrator and ESPECIALLY CITY COUNCIL.

The above picture was taken 3-2-15.  Notice they even changed their flag that is mounted to their porch on the south side of their home.

See above warning letter.  NOTICE how Ben reminds them , when they were in last summer 2014 to discuss this matter(their non compliant status) they covered up the word "VOGLS"on the rock, to attain compliance.  So they had been told more than half a year ago, by Ben Oleson exactly what they can have legally.  They just didn't care.

 And then they complain to the cops that I am harassing them by taking pictures and video legally from a public street.  If Randy Bjerkness, Kathy Barthel and Jim and Carol Vogl had the guts to complain to the city council and campaign for more signatures on the petition to get rid of the ultra restrictive sign ordinance....maybe THEN the city would listen to its citizenry.  How bout it guys?      

ALSO NOTEWORTHY.....I PUT THIS BLOG UP JUST TODAY AND WALLA.....THEIR FLAG ATTACHED TO THEIR PORCH IS gone.  

Will they stay compliant....or rebel again????¿¿¿¿   Time will tell.

This photo was taken on December 10, 2014.  They took down both flags and covered the VOGLS etched sign on the rock with duct tape.  Gee, I wonder why.  They were adived by the police officer to contact city hall about the sign ordinance rules and compliance.

Months have passed with them in non compliance of the sign ordinance.    They know full well, that they are in violation and don't seem to care.   I guess they feel they are "above the law."  

According to Ben Oleson, the zoning administrator and sign enforcer, they have been sent a warning letter on Monday of this week.  

Now don't get me wrong folks.  I feel that every homeowner should have the RIGHT TO DISPLAY FREE SPEECH SIGNAGE AND FLAGS TO THEIR HEARTS CONTENT.  But it is not to be in this ultra restrictive city.  

If people don't wish to be on my blog, then don't be out of compliance with the city sign ordinance. 

It is my right to exercise my free speech and I will continue to do so.

43 First Ave. Southeast .....over the legal limit for flags.....oops!!!!

If you look closely you will see that this property owner (43 First Avenue Southeast) Little Falls, Minnesota has a total of 6 visible flags.  There is a 7th(a tiny one at the base of the pole with the two flags flying (American and prisoner of war).  The sign ordinance of Little Falls, Minnesota only allows a maxium of 2 flags per property in a residential district.

  I have no idea if the people listed on these documents in their file at city hall still own this property or who lives here, but I hope they get compliant without a warning letter from the city. 

ATTENTION ALL VIEWERS.....UPDATE ON THE ILLEGAL DIGITAL ROYALTON BILLBOARD. 3-5-15

This morning 3-5-15, I spoke with Carol at the City of Royalton office about the Supreme Sign illegal off premise billboard case status.  She was very gracious in her answers and very polite.  Kudos Carol. 

She stated that the case is in mediation or negotiation status right now, with the two attorneys attempting to resolve the matter out of court.  City of Royalton attorney Toni Wetzel, and Supreme Signs represented by Tom Thielen (not Peter Vogel who was contacted earlier about representation).    I surely hope the City of Royalton gets their thousands of dollars in violation penalties that they are owed by Supreme Sign Company for violating the sign ordinance for a very long period of time.  $1,000.00 per day for a sign violation and  a new misdemeanor for every day in violation.  Let's see now.....I believe they have been in violation for close to if not in excess of two months, which would total $60,000.00 or so.  I requested a copy of the old Royalton sign ordinance be sent to me via email.  It was enacted in 1996.   Their new sign ordinance was passed in April 2014.

  I also mentioned that there are a number of other illegal signs on the main drag(hwy. 10) on light poles, on directional signage, and on the road right of way.  It is the council who is charged with enforcing the sign ordinance in Royalton.

 I asked about the Goldsmith Jewelers garage size sign that abuts Mark Schrauts fence.  (likely another illegal off premise sign).  I asked who owned that garage. She said she didn't know.   I wonder if it is also owned by the same man who owns Treasure City. 

If any city is going to enact  a sign ordinance, it is their duty to enforce it uniformly.   Not selectively.  Anything less, is a violation of the law. 

When the case is settled, there will be something in the council minutes about it.

Signs matter......they are one of the most important ways to communicate free and commercial speech.  I will continue to be keenly aware of sign issues in my state and beyond.  Shouldn't we all be ???

Royalton illegal off-premise billboard is dark...shut off

Yesterday 2-28-15 I noticed the Supreme Sign brightly lit digital electronic billboard next to Mark Schrauts home in Royalton, Minnesota was shut off.  I have displayed the picture I took.   If you remember I blogged about this a few weeks ago.

This picture below is of another illegal off  premise billboard, only THIS one is on the City of Little Falls property.  Oh oh.   City attorney Toni Wetzel and council know about this illegality and don't intend to do anything about it until this fall when the contract renewal is due.  How is it that this was allowed?  My guess is this is another Jerry Lochner screwup.  However, the buck stops at council and city administrators desk.

 

The picture below is the Royalton digital sign taken 1-27-15.

This picture with electricity shut off was taken 3-1-15.  I wonder if the city of Royalton had the electricity shut off to this sign?  That was a consideration at one point in their discussion in their meeting minutes.   Time will tell.  

Royalton City Council meets tonight 3-3-15.   The minutes should reflect the current status of the case.   Hopefully, Mark Schraut has won his battle with Supreme Sign Company and the City of Royalton should be a lot richer with all the daily penalties accrued due to their violation.   Thousands of dollars should be pouring into their coffers real soon.   At least that is, if the City of Royalton is enforcing their sign ordinance UNIFORMLY.   Supreme Sign and the owner of Treasure City(who owns the lot the billboard is located on) better have to pay the fines that are due because of this outrageous violation.  Let's see if Toni Wetzel(city attorney for Royalton) is on top of this one.   The sign ordinance of Royalton states that the City Council ENFORCES THE ORDINANCE.  Will they do their job?
