I was denied a bench in 4 different locations fall of 2017, by Jeff Waldvogel. I asked to have a bench at intersection of Cherry Ave SE and First Street, close to my house and abutting St. Gabriel's Hospital property. I was asked to provide the content on the bench. It was "Resist Don't Enlist....war is a racket". Hospital declined to allow me.
Second request was to be in front of the Franciscan Sisters Convent. Declined also.
Third was to be in front of Family Dollar store, to add a 3rd bench at intersection of highway 27 and 6th St. NE. Jeff Waldvogel refused to ask city to place a bench there...he said there wasn't room for 3 benches in that block. But in front of Coborns Superstore block there are 3. Jeff also said he would not allow a controversial message like Resist Don't Enlist, anywhere on a bench but WOULD allow my other proposed message " Consider Adoption, Difficult to Place Children deserve Forever Families".
I think you can see the problem here and continual message bias, that is an ongoing problem in this city.
Jeff's contract with the city allows him unfettered discretion on sign content.
This is a problem.
Long story short. The first advertising bench ordinance, AND the revised bench ordinance(rewritten during my free speech lawsuit), were BOTH illegal and likely UNCONSTITUTIONAL.....the first one was for sure. That's why Judge Kyle ruled in my favor on the bench ordinance not passing muster.

See below the city of Little Falls, Mn decided NOT to go ahead with the Limited Use Permit. That they will be removing the benches from the right of way.
