City staff and elected council officials RARELY enforce laws uniformly.  It's all selective and very illegal.

Good article.  I strongly agree.  The citizens don't have the first whack at stopping lawsuits - city officials do.  First because they make the decisions that can generate suits, second because they are required BY LAW to do what is lawful, and third because they have the resources to check the law BEFORE they act. 

One other interesting and IMPORTANT TIDBIT..... Bruce Smith, Bill Anderson and myself DID attempt to resolve things with city council/staff BEFORE filing a lawsuit.  It fell on deaf ears.  Left no other option for any of us.   This matters.

It's not a crime to be me. But the city of Little Falls thinks it is. My recent hearing on Nov.5, 2015 at the Minnesota Court of Appeals, will hopefully overturn my conviction. If not, it's on to the Minnesota Supreme Court. I did NOT commit disorderly conduct.

Armistice Day remembrance 2015 NO VETERANS DAY

WHAT...no policies and procedures LFPD and MCSO??? You must be kidding.

In early August 2015 I made a data request for the policies and procedures at the Little Falls Mn police department and the Morrison County Sheriffs Office. To date 11-7-15, I have NOT received them. The last communication with Lori Kasella (the responsible authority for Little Falls) on Oct. 29,21015 when I asked what was taking so long, her response was "The police department continues to work on them."  The last communication with Mary Swenson of the Morrison County Sheriffs Office on 10-29-15 when I inquired as to what was taking so long to get the policies and procedures, she stated " We are working on your request and will let you know when it is complete." 

So do either of these governmental agencies have the required by legislature policies and procedures in place or are they in the process of writing them?  Someone has said, if they don't have them, it is intentional as there are boilerplate model examples out there, a city or county just needs to fill in their name and responsible officials. 

Or, do they have policies and procedures but had to have League of Mn Cities big dog lawyers, city and county attorneys revise them because they were poorly written or not up to date?

My hearing at Minnesota Court of Appeals

Yesterday Nov.5, 2015 was my appeal in St. Paul.   It was very interesting, unlike any court hearing I have ever attended. Judges asked questions during the attorneys arguments, whenever they wanted to.....just like a panel discussion.  They asked many questions....some tougher than others. One question they asked was couldn't/shouldn't the council have had seating rules in place, rather than to criminalize sitting in a chair where others had been allowed to sit 4 days prior?  They pointed out correctly that I had asked council to show me the policy on seating.  The small courtroom was almost full. Decision within 90 days. If conviction is not overturned, we will appeal at the Supreme Court level.

decide for yourself.....did I commit disorderly conduct?   I think not.  Pretty clear.   Outside of council publicly "tarring and feathering" me, this is how they chose to publicly humiliate me for demanding to be treated the same as 7 others 4 days prior and expressing my free speech(notice my vintage apron, long skirt, small American flag in hand and American flag handkerchiefs on my head to represent before the civil rights era) and notice also that council and chief of police state clearly that they understood my message and what I was trying to convey.  Notice in the video below, President Don Klinker says "why aren't you in another country" (in response to my telling them that if someone was offended by my signs that showed images of children who are birth defected in Iraq from our depleted uranium and white phosphorus bombs, that they should pay more attention to what our country is actually doing in other countries) and then GREG ZYLKA WHO IS THE CURRENT MAYOR, laughs.   It has been said that "Men show their character in nothing more clearly than by what they think laughable."   

 

It should be painfully obvious to anyone watching these videos, what is really going on here.  They do NOT LIKE THE CONTENT OF MY SPEECH, AND WILL DO ANYTHING TO shut me up.  Including shutting down the public access television studio for over a year, to keep me off the air, taking away the public forum speaking time at ALL OF THE CITY COMMITTEE MEETINGS,  reducing the public forum comment time at council work sessions to 3 minutes, instead of 5, and eliminating citizen appeals and petitions time(which happened for the first time, at the June 3rd meeting, where I wore my colorful outfit and hat with signs on that said "Free Speech Restricted Here" and "Costly mistakes made regularly here"......I was opposing the elimination of citizen petition and appeals, as Theresa and I were presenting lots of great ideas through the petition method, at all previous meetings.  They not only were lacking a seating policy, but a camera placement policy, a sign placement policy and the rules they do have in place, are RARELY FOLLOWED.  They also make up rules as they go along, at their whimsy.  This is why I have referred to them as clowns.  My former First Amendment lawyers refer to Little Falls as a "Constitution Free Zone." That should tell you something.  I just used their phrase.  How many lawsuits will it take to force honest govmint?The June 3rd meeting is below. I did not own another camera to show where I was seated.  I wish I had.AND FOR YOUR ENTERTAINMENT....HERE IS ANOTHER MINNESOTA CITY COUNCIL with issues over the seating arrangement.  This time, it's council members themselves.

I think it MATTERS GREATLY that city violates the zoning ordinance by allowing multi-family housing in an R1C(1+2family) zoning district.

I want to know how many lawsuits against the City of Little Faals will it take, BEFORE citizens realize council clowns continue to exercise UNFETTERED DISCRETION,  misapply laws, selectively enforce ordinances, enact unconstitutional sign ordinances/amendments, skirt/subvert/ massage laws/rules......showing blatant favoritism to some people and THEIR popular viewpoint/speech?  Just how many. City is hellbent on paving a perfect freeway for another legal challenge, even after they have been repeatedly warned. Costs have not been high enough yet I guess.

Council denied tepairing Elm Street to it's previos status. Hypocrits.......

notice at end new city administrator Jon Radermacher talks about ACTIVE SHOOTER DANGERS and grants for security measure, equipment and plans.  The odd thing is that when Alderman Brian Crowder brought up the need for security cameras a few years ago, he was scoffed at and almost laughed out of chambers. He was ahead of his time and correctly concerned for the safety of all attendees, including the citizens who show up who have been repeatedly threatened. (Namely me)

 Pics taken 9PM 11-2-15....intersection of 4th St.SE and 2nd Ave SE Little Falls, Mn...directly across the street from one of the largest churches in town(St.Marys) and this is a main road.  This sign has been at this location for WEEKS, but no cop in town is willing to remove it, and follow their Chiefs command. Why?  Cuz they don't want to do either.....AND they get by with it.

Burnet Realty gutsy blatant lawbreakers

Picture taken 5:30pm 11-2-15....there was another identical flag and Burnet realty sign close to the stop sign and in the road right of way at the intersection of 1st St. SE and 5th Ave. SE.  The LFPD turned a blind eye to both all 4 of these R.O.W. ILLEGAL SIGNS AND FLAGS.   This is easy enough for a 1st grader to spot, but not your inept law enforcement.  Shame on the realtor that endangered traffic by placing these against MnDot AND the city sign ordinance. Can't fool me, that they did not know they were violating the law. This sign was placed along  a state highway, but Little Falls has jurisdiction on ROWs within city limits. All of these were along the MAIN roads. More, obvious SELECTIVE ENFORCEMENT.

The following pictures were taken 10-31-15 and HAVE NO REQUIRED PERMIT.  Why do these business owners feel they are above the law? Confirmed by Rich Munsch 11-2-15.....NONE have the necessary permit. Some might ask why this matters....because Camp Ripley and Main Gate Bar and Grille have REPEATEDLY ,knowingly, violated MnDot road right of way sign laws, AND our peace groups have in recent years been treated differently under the law. ON at least 2 different occassions the Morrison County Sheriffs department and multiple Mn. State  Troopers swarmed us,(me in particular) BEFORE our vigils were to start and MADE US REMOVE OUR SIGNS, that were only up for 2 hours, but all these others get by with it for days and some(Main Gate and Boomerang Bar) for MONTHS. That VIOLATES THE CONSTITUTION. That MATTERS.

Camp,Ripley abuses power again 10-30-15

 All of these signs are illegal signs in the state road right of way, Camp Ripley does NOT have permits FOR ANY OF THESE SIGNS.(as confirmed by Rich Munsch MNDOT today 11-2-15.

As of Saturday 10-31-15 at noon, all of these illegal signs were still up. Why doesn't Camp Ripley and it's soldiers obey the law?  They all swear an oath to uphold all the laws AND the constitution.  They are failing miserably.  Shame on all of them for continuing to abuse their power.....especially Col. St. Sauver.

Little Falls city council work session 11-2-15  informational sign ord amendments mtg.

All you who are passionate about your garage sale signs, better take a look at the proposed changes to the Little Falls sign ordinance. There has been a recent Supreme Court decision that affects sign ordinances everywhere. Show up Monday Nov.9th at 6:30pm sharp for the public hearing where every person gets to speak 2 minutes, then an additional 2 minute you want to be in the loop about city council intentions on the revisions to the sign ordinance. The June 18,2015 Reed v. City of Gilbert Supreme Court decision compels your council is making MORE revisions. Plus they want to favor certain groups or types of speech and squash mine.....same shi# , different day. I firmly believe, the current ordinance Violates the Constitution on many counts. It can't pass muster. So will the next one. Betcha. This is  why city staff deleted numerous clauses.

Why do you suppose they deleted BILLBOARD definition?

Event signs definition deleted. Why? Did this allow an "exception"?

Kiosk definition deleted. City has kiosks ALL OVER Little Falls. Are they constitutional? Bet not. Oh lookie below...Newspaper receptacles and mailbox exemption stricken. Suppose this is because of my LEGAL newspaper receptacle and mailboxes?

Murals below...notice the language stricken that says "and does not include any on or off site advertisement."(like the large Rexall Drug mural on the north facing side of Melgram Jewelers, and the Pete and Joys Bakery mural that faces west way up high on their building).

 Notice also the addition of "no more than 5% of the total area covered by the mural or 100 sq.ft.whichever is less, consists of text." Judge for yourself...don't these 2 murals violate that clause?

Real estate signs definition stricken.....likely unconstitutional because it favors realtors and construction signs over others.

Look at all the deleted language....it certainly appears they got alot WRONG.

NOTICE the comment on the side, about road right of way signs, by Ben Oleson, contracted zoning administrator. Allowing more flags in business districts than are allowed in residential, seems to violate the constitution. Why should they get more?

All off premise signs will be legal....anywhere in town. I am gonna  have fun with this one. Of course council is trying to accommodate the Senior Center donut sales, the Farmers Market, garage sales, church dinners, Chamber of Commerce, Great River Arts, Iniative Foundation, school events, VFW, American Legion, Lions, Kiwanis, KCs and other non profit fundraisers.  But now they HAVE to accommodate off premise speech they don't like too.

Notice they deleted the tobacco restriction on advertisements/promotion signs......because that probably violated the consitution.

Your city council just authorized a new lease with Franklin sign company, for a billboard on city owned property by the salt shed that is likely not legally permitted. (Still researching). I believe in doing so, they violated the current sign ordinance. That would explain the stricken language that billboards are only allowed out by the Morrison County fairgrounds on Hawthorne Road(city owns land out there).

Notice the addition of language to cover "signs for which there are insufficient records to determine their lawfulness at the time they were erected. Why they are REALLY sdding this langusge is because a number of complaints were filed(some years ago) and there are no EXISTING sign permits in the files. So instead of issuing warning letters to THESE violators, they are adding this protective buffer for them.(for instance the brick home across from Dairy Queen at the intersection of Riverview Drive and First St. NE that has a sign within a wrought iron fence, an etched sign on a large rock and a pillored rock sign(total 3, which is over the legal limit and signs etched in rock count towards total sq footage in the current ordinance. They just don't want to make THIS residence comply.....but Randall Bjerkness and I had to.

Notice there is absolutely NO written enforcement instructions/policy/plan to be voted on. If they don't pass one, they can enforce this law with total UNFETTERED DISCRETION. They are headed for quicksand. Any of you attending the public hearing, should insist they pass guidelines for the zoning administor or his agent to follow during enforcement.
